Questions to Ask the Lawyer

Mesothelioma Lawyers are highly qualified lawyers that understand asbestos injury and laws. It is very important that you find the right Lawyer to represent you and your family. Asbestos related injury claims are very specialized legal actions that require a highly qualified Lawyer. There are two questions you need to ask the Lawyer before assigning the case.

1. Ask the Mesothelioma Lawyer if he or she has personal experience in handling mesothelioma patients. The reason you ask this question is to determine how much experience the Lawyer and the Law Firm has in this type of law. Experince is important, you also want to know what percentage of the cases handled settled before litigation and what percent went to trail. Don't be afraid to ask the Lawyer what the type of results they have had. You want to be confident that the Attorney or Law Firm specializes in mesothelioma cases.

2. The second question you want to ask the Lawyer is if he or she will actually be handling the case. Many Lawyers refer these type of cases to another Law Firm. It is important for you to know who is handling your case and having passes on to another Law Firm may not be in your best interest.

Overview of the Claim Process

Each claim is handled on an individual basis and circumstances. It is important to note that being diagnosed with mesothelioma or other types of asbestos related cancer to in it self is not enough to recieve a settlement from the asbestos companies. An experience Lawyer needs to establish several factors such as where you where exposed and what products caused the exposure. Below is a general overview as to the process a Lawyer may follow to establish and build a claim.

1. The first step is to set up an interview and begin the process of gathering and compiling general and medical information about you and your mesothelioma case.

2.  The second step is to get a general idea on how you where exposed to asbestos and determine which asbestos companies are responsible for causing the mesothelioma or other asbestos related cancer or disease.

3.  The third step is to establish where you where exposed to asbestos and then determine which manufacturers, distributors and contractors supplied the asbestos to the specified location.

4.  Once the Lawyer has gathered enough information he or she will  file a lawsuit on your behalf. The next step is called the discovery phase where relevant information regarding the case is exchanged with the defendants. The purpose of the discovery phase is to prepare for trail or in the alternative gather information that may lead to future settlement discussions between your Lawyer and the Lawyers for the asbestos companies.

5.  Depositions is the next step before going to trail.

6. The trail.
